Active Matters

  • Currently acting for a Co-Administrator who is representing the Estate of his late father in Court proceedings relating to his grandfather’s Estate who is a former President of Kenya. The Co-Administrator’s grandfather’s Estate is valued at over USD 3 billion. The Estate encompasses multiple jurisdictions in Africa, Dubai, the United Kingdom, the United States of America and multiple tax havens.
  • Acting for a Judgment Creditor in the High Court in a suit seeking to enforce payment of a debt of approximately USD 3.29 million against the County Government of Kajiado. We have so far succeeded in having a sum of approximately USD 1 million budgeted for payment in the County Government’s Project-Based Budget for the Financial Year 2023/2024.
  • Litigating in the Environment & Land Court, and now at the Court of Appeal, on a property dispute involving co-tenants of a property in Parklands Nairobi worth USD 5 million in open market value. The dispute covers several issues, including inheritance rights, rights of co-tenants, and the rights of the Government on property having national heritage.
  • Acting for the Respondent in a Petition for divorce, alimony/spousal support in the range of USD 5,000 per month and division of matrimonial property. After a spirited fight we were able to successfully defend against the petition for spousal support and are on course to defend against the claim for an unreasonable division of matrimonial property.
  • Advised Heineken Brouwerijen B.V. and Heineken International B.V. on general litigation strategy for their USD 20 billion matter.
  • Acted for Mits Electrical Company against Mitsubishi Corporation, a Japanese multinational electronics and electrical equipment manufacturing company, in connection with a USD 8.8 million suit filed by our Client in the High Court of Kenya at Nairobi.
  • Representing victims of mobile money scams against Safaricom PLC, the largest and most profitable company in Kenya, on grounds that the telecommunications company has been negligent in implementing appropriate safeguards to protect holders of mobile money accounts and compensate them for losses incurred from mobile scams. The victims are seeking over USD 50 million as compensation.
  • Representing the victims of a gas explosion that occurred in February 2024 at a Liquified Petroleum Gas filling station that was illegally constructed and operating next to a residential area. The victims and residents near the gas explosion are seeking over USD 30 million as compensation from the several government authorities and the operators of the said filling station. Value aside, the outcome of the case shall set a precedent on the level of culpability of state agencies for disasters emanating from private businesses.
  • Representing Vector Aerospace Engine Services – Atlantic Inc., doing business as StandardAero, one of the world aerospace industry’s largest independent maintenance, repair and, overhaul (MRO) providers in a circa USD 4 million aviation dispute with Five Forty Aviation Limited trading as Fly540, a premier low costs airline in the East African region.
  • Representing Dr Tanay Sholapurkar and 33 Other Medical Practitioners in a USD 2 million employment claim for, among others salary arrears and constructive termination.
  • Representing Heineken International B.V. and Heineken East Africa Import Company Limited in the Court of Appeal in their USD 12 million appeal against an adverse judgment against them made by the High Court of Kenya in a matter involving the disputed termination by the Heineken Group of distributorship arrangements in Kenya.
  • Representing Mayfair Insurance Company, a leading regional insurance company, in a USD 210,000 commercial dispute involving performance guarantees.
  • Representing Africastalking Kenya in an ongoing shareholders’ dispute filed by its former Chief Executive Officer together with other shareholders.

Recent Victories

  • Successfully defended Heineken Brouwerijen B.V. against a circa USD 1.6 million claim filed by Modern Lane in Kampala, Uganda. This case was part of a cross-border dispute where we worked together with Ortus Advocates.
  • Successfully represented a group of expatriate medical doctors against the Mediheal Group of Hospitals and obtained a circa USD 6 million court award.
  • Successfully advised and represented StandardAero in a case against Airworks Kenya and in so doing helped StandardAero collect USD 500,000 in sums owed.
  • Successfully represented Araba Adebisi in a precedent-setting employment dispute against the Alliance for a Green Revolution in Africa, an international organisation with immunity. The Court was persuaded that AGRA could not assert immunity as a defence in the case, Mr. Araba was unfairly terminated and ought to be paid USD 127,000.
  • Successfully represented the grandson of a former President of Kenya by ensuring that a grant of legal representation of his late father’s estate, valued at over USD 600 million, was revoked and re-issued to include him as a co-administrator of the estate alongside 3 other co-administrators.
  • Successfully acting for Mission for Essential Drugs and Supplies in a constitutional petition currently before the Supreme Court seeking the invalidation of 23 laws for inter alia lack of public participation and not following constitutionally laid down procedures for passing of laws between the two Houses of Parliament. This includes a law that monopolised the supply of medical equipment and medication to public health facilities in favour of one government entity which was prejudicial to the interest of our client which controls 20% of this sector in Kenya. This case is being closely followed by the Kenyan public for its high jurisprudential value noting that the outcome at the Supreme Court shall have a big bearing on the law-making process in Kenya.
  • Successfully defended Africastalking Kenya against certain defamatory allegations that were published against it by TechCabal, Fintech Association of Kenya, the Founder Africa, and Innovation Village. Within one week of our appointment, we had seen to it the retraction of the false story from all four websites.
  • Successfully represented one of the Creditors’ Committees of Cytonn Investments Management, securing a strategic engagement with stakeholders to restructure the balance sheets of Cytonn High Yield Solutions and Cytonn Project Notes. This approach, in lieu of liquidation, is projected to recover at least 100% of the principal investments for unsecured creditors, minimising losses from an estimated 86% to only interest earned post-COVID valued at USD 106,463,877.
  • Successfully represented SRJD in a dispute over a highly valuable property of circa USD 4.5 million in Nairobi, currently under appeal. The case involves critical legal questions about the bequeathal of present and future land interests through a Will, the rights and limitations on beneficiaries, and the obligations of co-tenants. We argued before the Court of Appeal that SRJD’s present and future interests in the property should have been recognised and protected, challenging the Environment and Land Court’s decision to order a sale at the request of other co-tenants.
  • Successfully represented Saharan Link in a claim against Zoscales Partners AG for wrongful termination of a consultancy contract, seeking USD 45,000. Zoscales Partners AG has counterclaimed for USD 1.5 million, citing various alleged infractions. Our role involves defending against this counterclaim and seeking its dismissal with costs. The litigation centers on the proper termination of a management consultancy contract for services provided to Zoscales Partners AG’s investee companies across sub-Saharan Africa, assessing the resulting damages and determining liability.
  • Acting for Kilimanjaro Safari Club with instructions to collect a debt owed to it by the County Government of Kajiado. The debt, principal plus interest, is for a cumulative USD 7 million and entails damages awarded to the Client in the year 2011 in an arbitration against the County Government, interests to date and costs.
  • Successfully negotiating with the County Government, the settlement of a sum of USD 1,954,524 owed to a client arising from a land dispute that had spanned about seventeen years by the time of our appointment as counsel.
  • Litigating in the Environment & Land Court and safeguarding a client’s interest in property, which interest was liquidated at USD 651,508.
  • Shielded the Estate of the late Prieya Gandhi from paying USD 427,400.68, by having a default judgment in favour of UBA Bank set aside on grounds that the suit abated.
  • Shielded the Dipa Pulling Estate from paying USD 170,000 in Advocate/Client fees in Nairobi JR Misc. E198 of 2021 and securing winnings of over KES 125 million for the Dipa Pulling Estate in Nairobi ELCC No. 200 of 2008.
  • Secured a win of over KES 97 million for Satya Gandi in Nairobi Succession Cause No. 769 of 1988.
  • Successful win of over KES 7.5 million for MUA in Nairobi HCCC No. 511 of 2008.
  • Successful win of over KES 2.2 million for MEDS in Nairobi CMCC No. E427 of 2022.
